Terms of Service

These terms govern your use of the Utter website, macOS application, account, and related services.

1. Agreement

By accessing or using Utter, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be at least 16 years old and able to enter into a binding agreement.

2. What Utter provides

Utter is a macOS productivity tool that converts text you select into spoken audio. Narrate mode reads selected text; TL;DR mode uses AI to produce and speak a shorter summary. Features may change as the product develops.

Utter is not a substitute for professional legal, medical, financial, safety, or other specialist advice. AI-generated summaries can omit, simplify, or misinterpret information. Review the original source before relying on important content.

3. Your account

You are responsible for keeping your account secure, providing accurate information, and promptly notifying us of suspected unauthorised access. If you sign in through Google, your use of that account remains subject to Google's applicable terms.

You may not share credentials, create accounts through automated means, impersonate another person, or use another person's account without permission.

4. Your text and permissions

You retain ownership of text and other content you submit for processing. You grant Utter a limited, worldwide, non-exclusive licence to process that content solely to operate, secure, and provide the requested feature.

You must have the right to process the content you select. Do not use Utter to process information in a way that violates privacy, confidentiality, intellectual-property, employment, or other legal obligations.

5. Acceptable use

You must not:

  • use Utter for unlawful, deceptive, harmful, or abusive activity;
  • submit malware or attempt to compromise the service or another user;
  • probe, scan, overload, or circumvent security or usage limits;
  • reverse engineer the service except where law expressly permits it;
  • use automated means to scrape, resell, or reproduce the service;
  • infringe intellectual-property, privacy, or other rights.

6. Utter's intellectual property

Utter and its licensors own the application, website, software, branding, design, documentation, and other service materials, excluding your content. Subject to these terms, we grant you a limited, revocable, non-transferable licence to use the application for its intended purpose.

7. Plans, billing, and refunds

Utter may offer a free plan with usage and feature limits. The current Pro plan is $6.99 per month. Paid subscriptions renew automatically each month until cancelled, and applicable taxes may be added depending on your location.

You may cancel at any time to stop future renewals. Unless required by law, payments are non-refundable after the first 45 days. If Pro is not right for you, contact hello@tryutter.app within 45 days of your first Pro payment to request a full refund.

8. Third-party services

Utter relies on third-party services, including Google for optional sign-in, OpenAI for AI and speech processing, and infrastructure providers for hosting and delivery. Their services may be governed by their own terms and policies. We are not responsible for third-party services outside our control.

9. Beta features and availability

Pre-release, beta, or early-access features may be incomplete, unstable, or changed without notice. We may modify, suspend, or discontinue parts of Utter, and we do not guarantee uninterrupted or error-free availability.

10. Suspension and termination

You may stop using Utter at any time and request account deletion by emailing hello@tryutter.app. We may suspend or terminate access where reasonably necessary to protect users or the service, comply with law, address non-payment, or respond to a material breach of these terms.

11. Disclaimers

To the extent permitted by law, Utter is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Nothing in these terms excludes rights or warranties that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Utter will not be liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, revenue, data, goodwill, or business opportunity. Our total liability arising from the service will not exceed the greater of £100 or the amount you paid Utter in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot legally be limited.

13. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that consumers may have mandatory rights to bring claims in their country of residence.

14. Changes and contact

We may update these terms to reflect product, legal, or operational changes. We will post the revised terms and provide reasonable notice of material changes. Questions can be sent to hello@tryutter.app.
